Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the Lemnisket platform, website, and related services (collectively, the "Services") provided by Lemnisket. By creating an account or using the Services, you agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy (which are incorporated by reference). If you do not agree with these Terms, you must not use the Services.

These Terms constitute a legally binding agreement between you and Lemnisket (the company operating the Services). Lemnisket is based in Montreal, Quebec, Canada, and these Terms are provided in English for convenience. A French version is available below. We strive to ensure these Terms comply with applicable laws including Québec's consumer protection laws and relevant international regulations.

Eligibility

You must be at least 14 years old to use the Services. By using Lemnisket, you represent that you meet this minimum age requirement. If you are under the age of majority in your jurisdiction (for example, under 18 years old in many places), you must use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly allow children under 14 to create accounts in compliance with Quebec privacy law.

Account Registration and Security

When you create an account, you agree to provide accurate, current, and complete information about yourself as prompted by our registration form. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately at chris@lemnisket.com if you suspect any unauthorized use of your account or any other breach of security.

Lemnisket will not be liable for any loss or damage arising from your failure to safeguard your account credentials. You must use your account personally and not share it with others. You may not transfer your account to someone else without our prior written permission. We reserve the right to require users to re-validate their credentials or information if we suspect an account breach or inaccurate information.

Permitted Use of the Services

Subject to your compliance with these Terms and any applicable laws, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial educational purposes. All content available through the Services (including text, videos, quizzes, software, code, graphics, and course materials) is owned by Lemnisket or its licensors and is protected by intellectual property laws. You may access and use the content solely for your own learning.

Prohibited Conduct

You agree not to engage in any of the following activities:

• Unauthorized Copying or Distribution: You will not copy, reproduce, record, screenshot, distribute, publicly display, or create derivative works from the content on the Services without our express written permission.
• Reverse Engineering: You will not attempt to reverse engineer, decompile, or extract the source code of our platform or any part of the Services, unless permitted by law.
• Circumvention of Security: You will not attempt to circumvent any security features or access controls of the Services.
• Misuse or Illegal Activities: You will not use the Services for any illegal or unauthorized purpose, including harassment, bullying, or defamation of other users.
• Interference: You will not interfere with or disrupt the proper operation of the Services or any servers or networks connected to the Services.
• Automated Use: You will not use any automated systems to access the Services without our prior permission.

Lemnisket reserves the right to investigate and take appropriate legal action against anyone who violates these rules, including suspending or terminating accounts.

Refund Policy

We want you to be satisfied with your learning experience. If you purchase a course or subscription and are not satisfied, you may request a refund within 14 days of your purchase. We will honor refund requests made within 14 days from the purchase date, provided that we may ask for feedback on what went wrong so we can improve.

Disclaimer of Warranties

LEMNISKET PROVIDES THE SERVICES AND ALL CONTENT ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, LEMNISKET DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE OR ERROR‑FREE.

Limitation of Liability

To the maximum extent permitted by law, Lemnisket will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our aggregate liability for all claims will not exceed the amount you have paid to Lemnisket in the six months preceding the claim or CAD $100, whichever is greater.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any disputes will be subject to the jurisdiction of the courts of the Province of Quebec, District of Montreal.
